Price Guarantee Rules
The SecureNet ("Sponsor") Price Match Guarantee program allows you
to sign up for a SecureNet account with the knowledge that you are getting the best possible
rates in the industry. By participating in the program, you
acknowledge that you have read, understood, and agree to be bound by these Program Rules.
Rules Overview |
1. The rates you currently have must be above Interchange, Dues, Assessments and Fees.
2. Only one location is counted in a franchise environment.
3. Current processing must not be combined or tied to any other offer such as banking, other services, etc...
4. A Merchant can only be awarded one time.
5. SecureNet must be compatible with the Merchant's front end (POS) system.
6. IP Transactions only.
7. Actual processing statements must be provided, verbal description or proposals are not acceptable.

- Eligibility: Only available to new SecureNet clients. In order to receive the price match cash bonus, a current statement must be provided. No proposals or oral information will be considered.
SecureNet reserves the right to disapprove of an account if it determines that any of the following conditions apply;
i) the perspective client is a pre existing client
ii) the perspective client's processing is tied to other services
iii) the perspective client does not pass SecureNet's underwriting guidelines.
- Cash bonus: For each of your "Merchants" that participates in the "Promotion" under this program, SecureNet will credit the "Merchant" account based on the following schedule:

A "Merchant" will only be deemed to have participated in the "Promotion" for the purposes of these program rules at the time that they receive
approval for the account application and processes a minimum of $25,000 per month.
- Remedies for your noncompliance: If "Sponsor" determines at its sole discretion that you have not complied with these program rules, it may
immediately and without notice to you , withdraw all benefits to you and your "Merchants" under this program (including, without limitation,
canceling or declining to apply to your account, any or all awards issued or to be issued to your and to any of your "Merchant" in connection with this
program and, by declining to send or stopping from being sent, a Merchant emails).
- Limitation of liability for sponsor: To the fullest extend permitted by law, neither the "Merchantr" nor any of its affiliates, directors,
employees or other representatives will be liable for damages arising out of or in connection with this program. This is a comprehensive limitation
of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss
of data, income, or profit; loss of or damage to property; and claims of third parties.
- Currency: All amounts stated in these Program Rules are in US dollars.
- Entire agreement: These program rules represent the entire agreement between "Merchant" with respect to this program.
- Variation of program rules: These program rules may be amended or modified by SecureNet at its sole discretion at any time. Any such amendments
ill be posted to this page and it is your responsibility to review this page from time to time for such amendments.
- Severance: In any provision of these program rules is held to be invalid; such invalidity will not affect the remaining provisions.
- Governing Law: These program rules will be interpreted, construed, and enforced in all respects in accordance with the laws of the State of Maryland,
without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the nonexclusive personal jurisdiction of
the state and federal courts within Maryland, for the purpose of litigating any such action.
- Additional Terms and Conditions: SecureNet reserves the right to modify, suspend or terminate the Program in its entirety at any time and for any
reason in its sole discretion. Void where prohibited by law. This Program and these Terms and Conditions are subject to all applicable federal, state and
provincial laws and regulations. Any credit will be net of taxes and you must pay any applicable taxes. If in SecureNet's opinion, there is any suspected
or actual evidence of electronic or non-electronic tampering with any portion of the Program or the credits, or if a computer virus, bugs, unauthorized
intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper
conduct of the Program, SecureNet reserves the right at its sole discretion to disqualify any individual involved in any such harmful or illegal activities,
and to modify or suspend the Program, or to terminate the Program. Any attempt by an entrant or any other individual to deliberately damage any web site or
undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, the SecureNet reserves the
right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site
associated with this Program via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible,
in addition to any other remedies available at law or in equity. Use of automated, programmed, falsified or the like entry devices or programs is prohibited
and all such entries are void.
